d) Model Updates Outside Your Control

Off-the-shelf AI systems are not static. Vendors may push new model versions that introduce new biases or remove previous safeguards, which may change output quality, modify data handling practices, or expand use cases through updates.

e) Bias Propagation and Contextual Misalignment

It is important to verify if the outputs match our acceptable standards.

f) Confident Nonsense

Generative AI will confidently produce plausible but entirely fabricated information. When people trust these outputs without verification, things go sideways fast.

  • Lawyers filing briefs that cite non-existent case law (this has happened multiple times now).

  • Customer service reps sending communications with factual errors.

  • Analysts making recommendations based on hallucinated data.

  • How transparent are they about capabilities, limitations, and known failures?

  • Do they communicate updates and changes proactively?

  • How have they handled incidents in the past?

You're not negotiating, rather deciding if their standard offering meets your minimum bar. If it doesn't, choose a different vendor or accept the risk with compensating controls.

Negotiate Where You Can

For enterprise AI tools where you do have procurement contracts: specialized vendors, SaaS platforms with embedded AI: push for what matters:

  • Explicit limits on using your data for training

  • Rights to notification before significant changes

  • Clear incident response protocols

  • Data deletion guarantees on exit

Even when you can't get custom terms, understanding what you're agreeing to helps you plan around identified gaps.

Control What Matters Most

Regardless of vendor terms, you completely control:

  • Access: Who can use which tools

  • Inputs: What data can enter AI systems (via policy and technical controls)

  • Outputs: When human review is required before AI outputs are used

  • Use cases: What's approved vs. prohibited

  • Monitoring: Visibility into usage patterns and anomalies

  • Verification: Built-in checks before AI affects decisions or reaches customers

Vendor certifications and policies establish a baseline for assessment. They don't transfer your governance obligations. Your framework has to work regardless of what vendors promise.

Regulators, auditors, and courts will ask what you did, and what safeguards you have implemented, not what the vendor promised.

5. Practical AI Governance Controls You Can Implement Quickly

AI governance does not need to start with complex compliance tools. It starts with visibility and guardrails. A well-maintained spreadsheet works fine at the start. High-impact controls are often organizational, procedural, and policy-based.

a) AI Use Case Inventory and Classification

Start by answering one simple question: Where is AI actually being used in our organization today?  A simple inventory often reveals unknown risk exposure:

  • Tool and vendor

  • Business function

  • AI capability type (chatbot, scoring, prediction, generation)

  • Data types involved

  • Decision criticality

b) Data Input Guardrails
